Can I be arrested for loan app debt in my country?
Generally, NO. The vast majority of countries (including the US, India, and the UK) have abolished debtors' prisons. You cannot be arrested simply for failing to pay a civil debt like a credit card or loan app bill .
EXCEPTIONS (Where you CAN be arrested):
- Fraud: If you used a fake ID, stole someone’s identity, or took out the loan with zero intention of paying (criminal fraud), you can be arrested for the crime of fraud, not the debt itself .
- Criminal Contempt: If a court orders you to appear for a debtor's exam (to list your assets for garnishment) and you refuse to show up, the judge can issue a warrant for your arrest for "contempt of court."
- Non-Payment of Court Fines/Taxes: You can be jailed for refusing to pay taxes or criminal fines, but not for defaulting on a loan app .
Threats to watch out for: Unethical loan app collectors often threaten arrest to scare you. This is illegal in most jurisdictions.
