Can loan apps legally call my friends and family?

In most countries, NO. Calling your friends, family, or employer about your debt is generally illegal unless you specifically gave permission.


Let me break this down by country because the rules are different everywhere.

United States – The Fair Debt Collection Practices Act (FDCPA)

The FDCPA is very clear about third-party contacts. A debt collector can only contact someone else for one reason: to find out your location (address, phone number, workplace). They cannot discuss your debt with that person .

The FTC has enforced this strictly. In one case, North American Capital Corporation agreed to pay a $250,000 civil penalty for making impermissible third-party contacts, including calling consumers' employers and co-workers .

What debt collectors CANNOT do under the FDCPA:

  • Call you at work if they know your employer prohibits such calls 
  • Talk to third parties (neighbors, children, employers) about your debt without your consent 
  • Use obscene or profane language 
  • Call you before 8:00 a.m. or after 9:00 p.m. 
  • Threaten actions they cannot or do not intend to take (like wage garnishment without a court order) 

Important Limitation: The FDCPA generally applies to third-party debt collectors, not the original lender. However, many loan apps sell your debt to collection agencies, at which point the FDCPA applies.

United Kingdom – FCA Rules

The Financial Conduct Authority (FCA) has strict rules about debt collection. Harassment is prohibited. This includes repeated phone calls, contacting friends and family, and any behavior that could be considered intimidating.

Canada – Provincial Laws

Each province has its own consumer protection laws. Generally, debt collectors cannot contact third parties about your debt without your permission. The Criminal Code also prohibits harassment.

What Loan Apps Actually Do

Here is the reality: Predatory loan apps often hide permission to contact your contacts in their terms and conditions. When you click "I agree," you may be giving them legal permission to call your friends and family.

This is why the Kerala Police warning is so important: Never give a loan app access to your contacts. If the app requires this permission to function, it is planning to use your contacts against you.

Step-by-Step Action

Step 1: Read the permissions screen carefully before installing any loan app. If "Contacts" is listed, deny it.

Step 2: If an app already has your contacts and is calling your friends and family, document everything – screenshots, call logs, dates.

Step 3: Send a written request (email or letter) demanding they stop contacting third parties. Keep a copy.

Step 4: Report violations to your country's regulator:

  • US: FTC at ReportFraud.ftc.gov or CFPB
  • UK: FCA or Stop Loan Sharks (0300 555 2222)
  • Canada: Your provincial consumer protection agency
  • Nigeria: FCCPC

Step 5: If the harassment continues, consult a lawyer. You may have grounds for a lawsuit.
