Can CheckMate contact my friends or family?

Back

Physical CheckMate locations: YES, but only under strict regulations. They can call references you provided on your application, but they CANNOT disclose the purpose of the call (the existence of your debt) to anyone except you or your spouse.

Fake CheckMate App: YES, and they will do so aggressively and without legal restraint.

How They Get Contact Information:

  1. You provided references on the application form (legitimate)
  2. Contact permission granted during app installation (predatory)
  3. SMS/Call log access – They see who you talk to most frequently
  4. Social media scraping – They find your publicly visible friends and family

What They Can Do With This Information:

  • Locate you when you change your phone number
  • Pressure you indirectly by contacting people you care about
  • Embarrass you into paying by exposing your debt
  • Verify your employment and residence through your contacts

What the Law Says (US Fair Debt Collection Practices Act):

A debt collector MAY contact a third party ONLY to:

  • Locate your address or phone number
  • Confirm your employment
  • And they CANNOT:
  • Reveal that you owe a debt
  • Contact the same third party more than once (unless invited)
  • Use abusive or threatening language

How to STOP Third-Party Contact:

Immediately upon discovering a lender has your contacts, send this message in writing (email and certified mail):

"I am revoking any express or implied consent for you to contact any third party regarding me or my account. You are directed to communicate with me directly and exclusively. Any further contact with my friends, family, employer, or any other third party will be treated as a violation of federal debt collection law, and I will pursue all available legal remedies."

Keep proof. If they violate this instruction, you have grounds for a lawsuit and potential damages.
